West Virginia Disabled Veteran Benefits: Property Tax Credit, Plates, Tuition & More

West Virginia goes out of its way for disabled veterans — and the benefits go beyond the monthly VA check. The state offers a refundable property tax credit that can cover your entire homestead tax bill, free registration on a Disabled Veteran license plate, fully tax-free military retirement pay, tuition waivers for your family, free hunting licenses, and hiring preference in state jobs.

Here's who qualifies, what you get, and how to apply.

Property Tax: The Disabled Veteran Real Property Tax Credit

This is the most valuable benefit most disabled veterans miss. The Disabled Veteran Real Property Tax Credit is a refundable credit against your West Virginia income tax equal to the property taxes you actually paid on your home. "Refundable" means that if the credit exceeds the tax you owe, the state sends you the difference — your homestead property tax comes back to you.

Who qualifies

  • Honorable discharge from any branch of the U.S. Armed Forces.
  • A combined VA disability rating of 90 to 100 percent, totally and permanently disabling and service-connected.
  • The property must be your homestead — the home you live in. A house or a mobile, manufactured, or modular home counts, and the credit applies only to the property where you primarily live.

How it works

The credit equals the real property tax you paid on time on your homestead. Taxes are split into two halves: the first is due by October 1, the second by April 1. Delinquent or back taxes don't qualify. You claim it by filing Form DV-1 with your regular state return (IT-140), along with your property tax receipts and your VA disability rating letter. Any excess is refunded.

You can't take the Senior Citizens Tax Credit or the Homestead Excess Property Tax Credit in the same year — the disabled veteran credit takes precedence and stands alone.

Surviving spouses

A widow or widower who has not remarried keeps claiming the credit on the same homestead unless the property is sold or reclassified — one of the most valuable survivor benefits in the state.

The $20,000 Homestead Exemption (100% P&T Veterans)

West Virginia's general homestead exemption removes the first $20,000 of assessed value of your primary residence from taxation. It's aimed at homeowners 65 and older, but veterans certified permanently and totally disabled by the VA qualify too — and on a modest home that can eliminate the property tax entirely.

Veterans rated 90-100 percent usually get more back from the credit above, because it refunds what you actually paid — your county assessor can help you compare.

How to apply

  • File with your county assessor's office, with a VA letter certifying permanent and total disability.
  • The state normally requires two consecutive years of residency, with a military exception: if you were a resident when you entered service, kept West Virginia as your legal residence, and returned after retirement or a service-connected discharge, you qualify without the wait.
  • Watch the deadline: applications are due by December 1 following the July 1 assessment date for the tax year you want covered.

Vehicles: Free Registration on Disabled Veteran Plates

With a 100 percent total and permanent service-connected rating — or a VA auto grant (adaptive equipment assistance) — you can register a vehicle with a Disabled Veteran plate and skip the registration fee. The plate comes in 10-year cycles with a DV number; you'll still pay the insurance enforcement fee (50 cents) and litter fee ($1.00) for each year remaining in the cycle.

A separate Disabled Veteran Mobility Impaired plate covers veterans whose disabilities include a mobility impairment; registration fees are waived under West Virginia Code §17A-10-8.

  • Purple Heart recipients, former POWs, and Pearl Harbor survivors get special plates without fee.
  • Any honorably discharged veteran can get a veteran plate for a one-time $10 fee on top of regular registration.
  • A surviving spouse keeps the Disabled Veteran plate until remarriage.

Income Tax: Military Retirement Pay Is Not Taxed

West Virginia does not tax military retirement pay from the regular Armed Forces, Reserves, or National Guard — including survivorship annuities — with no age test and no income limit. Claim it on Schedule M, line 32 of Form IT-140 and attach your 1099-R.

  • VA disability compensation is exempt from federal tax and never reaches your West Virginia taxable income.
  • Dependency and Indemnity Compensation (DIC) paid to survivors is tax-free too.
  • Separated after at least 30 continuous days of active duty? Your active-duty pay for that year can be subtracted from state income (the Active Military Separation modification) — include your orders, DD-214, and W-2.
  • SCRA protections apply to service members and spouses: military income is taxed only by the state you elect as legal residence.

Education Benefits for Families

War Orphan Education Program

The child (ages 16 to 25) or spouse of a veteran killed in action or dead of war service gets tuition and fees waived at any West Virginia state post-secondary institution, plus up to $1,000 per semester (maximum $2,000 per year) toward room, board, books, and living expenses. The stipend can fluctuate with applications; the tuition waiver is the anchor. It stacks on top of federal Chapter 35 (DEA) and the Fry Scholarship.

Two conditions most people miss: the veteran must have designated West Virginia as the state of record at enlistment, and applications are due August 31 for fall and January 31 for spring — the program is never retroactive.

Medal of Honor and Purple Heart tuition waiver

West Virginia residents awarded the Medal of Honor or the Purple Heart get tuition and mandatory fees waived at all public colleges and universities (West Virginia Code §18B-10-10).

More education help

  • Veterans Re-education Assistance: up to a $500 per semester stipend for veterans in certified post-secondary courses. Funded through the annual budget, so confirm the current level with the Department of Veterans Assistance.
  • In-state tuition: WV public colleges charge the in-state rate to veterans using education benefits and their dependents (38 USC 3679).

Hunting, Fishing, and State Parks

Resident veterans rated 100 percent permanently and totally disabled, veterans with a VA auto grant, and former POWs get free West Virginia hunting, trapping, and fishing licenses. Active-duty members on leave can hunt, fish, and trap without a license — just carry your leave papers.

The state parks also run the Veterans' Salute program: veterans and active-duty military get a 10 percent discount on standard lodge rooms, cabins, and campsites year-round, with extra seasonal offers.

Employment and Business Benefits

West Virginia adds preference points to state employment exams (Code §6-13-2): 5 points for veterans who served on active duty, 10 points for disabled veterans and Purple Heart recipients. Points apply to passing scores only; military experience counts toward job qualifications.

  • The Military Incentive Credit gives tax credits to private employers who hire economically disadvantaged veterans and unemployed Guard and Reserve members.
  • The Boots to Business waiver (Secretary of State) waives business registration fees for veterans and their spouses.
  • CVOB/CMPOB certification verifies businesses at least 51 percent owned by a veteran, service member, or spouse — a credential that helps with state and federal contracting.

Your Step-by-Step Action Plan

  1. Get your VA rating letter. Download your official ratings decision from your VA.gov account — almost every benefit here starts there.
  2. File for property tax relief. Rated 90-100 percent? File Form DV-1 with your state return and keep your property tax receipts. Rated 100 percent P&T? Ask your county assessor about the $20,000 homestead exemption — and which option pays you more.
  3. Visit the DMV. Bring your rating letter and the Disabled Veteran plate application (DMV-48-D, or DMV-48-DI for the mobility-impaired plate) to your local DMV regional office.
  4. Check your tax setup. Military retirement goes on Schedule M, line 32, with the 1099-R. If you separated this year, look at the Active Military Separation modification.
  5. See a VSO. A Veterans Service Officer at your local West Virginia Department of Veterans Assistance benefit office handles the education applications, free hunting license paperwork, and anything you missed — at no cost to you.

Frequently Asked Questions

Do disabled veterans pay property tax in West Virginia?

Qualifying veterans can get their homestead property taxes returned through the refundable Disabled Veteran Real Property Tax Credit (90-100 percent ratings), and the $20,000 homestead exemption removes assessed value from taxation for 100 percent P&T veterans. Many disabled veterans end up paying little or no net property tax on their home.

Can I claim the disabled veteran credit and other property tax breaks together?

The Disabled Veteran Real Property Tax Credit can't be combined in the same year with the Senior Citizens Tax Credit or the Homestead Excess Property Tax Credit. The $20,000 homestead exemption is a county-level exemption under separate law — ask your county assessor which path fits you.

Is military retirement pay taxed in West Virginia?

No — military retirement pay from the regular Armed Forces, Reserves, and National Guard is fully exempt, including survivorship annuities. Claim it on Schedule M, line 32.

Do disabled veterans get free hunting and fishing licenses?

Yes — residents rated 100 percent permanently and totally disabled, veterans with a VA auto grant, and former POWs qualify for free hunting, trapping, and fishing licenses from the WV Division of Natural Resources.

My parent was killed in service — can I attend college free?

If the veteran named West Virginia as state of record at enlistment and died as a result of war service, children ages 16 to 25 (and spouses, no age limit) get tuition and fees waived at WV state schools through the War Orphan Education Program, plus a living-expense stipend. Apply by August 31 (fall) or January 31 (spring); the program is never retroactive.

The Bottom Line

West Virginia's disabled veteran benefits add up to real money: a refunded property tax bill, free vehicle registration, a state income tax that ignores your retirement pay, tuition waivers for your family, and free run of the mountains. None of it is automatic — the credit needs the right form, the plate needs the right application, and deadlines are unforgiving. Every benefit is one appointment or one form away.

Start with the property tax credit and Form DV-1, your biggest single return. Then see a Veterans Service Officer at the West Virginia Department of Veterans Assistance to make sure nothing goes unclaimed. These benefits exist because you earned them — the only way to lose them is to never apply.
